The session fee pays for the time and talent of the photographer only and does not include any finished portraits.  The session fee is due at the time of booking your portrait session and holds your appointment time.  Sessions are not booked without a creation fee.   Cancellations prevent us from booking the time slot with another client, therefore all session fees and/or deposits are non-refundable.  However, with 48 hours notice a session may be rescheduled because of illness or an emergency. Requests for photo sessions on any day that is determined by the studio to be a non-working day (Sundays) will require a double session fee and a minimum purchase amount of $1000. 

Please leave in plenty of time to arrive early as this helps the session start more relaxed. Also we will be photographing you in what you arrive in, so start with the least important outfit. Please bring only the subjects to be photographed in the session. This is especially important with kids, as Brandon will need their full attention rather than looking at other members of the family. Of course parents are always welcome! Standard sessions do not limit the number of subjects, but mini sessions are limited to three individuals or one family unit. If you have a sick child/pet on the day of the session, please call to reschedule. If you try to keep the appointment, we will most likely request that you reschedule if we notice your child/pet is sick. Sick or uncomfortable children do not like to be photographed and we know that you will not love your portraits nearly as much as if your child was in good health. When guidance is given by the studio on how to dress or otherwise prepare for your session, it is then the clients responsibility to follow the provided guidance. Not following the provided guidance may result in an unsuccessful photo session with photos that will not satisfy you. If such should occur, the studio is not obligated to provide a second session without charge or to provide any amount of refund for services rendered. The studio is not liable or responsible for hair, makeup, or wardrobe malfunctions, though we will aim to correct them as we see them. Please let the studio know if you have any questions about outfits or looks that you would like to try that are not part of the studio guidance.

My involvement and/or participation in a portrait session is voluntary, and I am acting under my own free will. There is a risk of danger, bodily harm, injury, emotional stress, or death as a result of my participation. The risks arise from hiking, standing and posing in potentially precarious locations, tripping or falling in-studio, head injuries with large studio equipment and any other potential risks not limited to this list. There is the potential for risks and dangers that may not be obvious or reasonably foreseeable at this time. I do not have any medical ailments, physical limitations, or mental disabilities that will affect my ability to participate in a photography session. Brandon Malone, Brandon Malone Photography and it’s employees/contract workers, spouses and next of kin (hereinafter called RELEASEES) undertakes no direct legal or financial responsibility for my personal safety or well being when I am participating in a photo shoot. I assume the risks, including, but not limited to, those outlined in this agreement. I forever release Brandon Malone Photography, Brandon Malone, all related participants and releasees from any and all claims and causes of action that I or my representatives now have or may have in the future for personal injury, property damage or wrongful death occurring to me, arising out of participation in a photography session. I am 100% liable for all medical expenses incurred as a result of any injury or property damage during my participation in a photography session. In the event that any one or more of the provisions of this agreement shall be held invalid, illegal, unenforceable or in conflict with the law according to the jurisdiction of the state of Maryland, the remaining portions will not be invalidated, and shall remain in full force and effect. I/we agree not to sue any Releasee, and I/we release and agree to indemnify Releasees from and for all liability to the undersigned, his/her personal representatives, assigns, heirs and next of kin for any and all loss or damage, and any claims or demands thereafter on account of injury to the person or property of death of undersigned whether caused by the negligence of the Releasees or otherwise. I/we agree that this release, waiver and Indemnity agreement is intended to be as broad and inclusive as is permitted by the laws of the State where these activities are conducted, and if any part thereof is held invalid, it is agreed that the balance shall continue in full force and effect. I/we have read and voluntarily signed this agreement and further agree that no oral representations, statements or inducements apart from the foregoing written agreements have been made.

While Brandon does capture many images during your session, you will see only those images selected by him, the artist, for previewing.  Images with eyes closed, heads turned, duplicates, etc., will not be shown and are removed from my archives permanently after the artist rendering in complete.  We always strive for excellence.  You will view your portraits as a personally attended slideshow.  Standard Portrait clients will be shown between 30-50 images.  Mini-Session clients will be shown 10-20 images.  You will be asked to order at that time.  Once your order is placed in-person and you decide to invest in one or more of our products valuing $500 or more, an online gallery will be available for 14 days to send to family and friends.  After 14 days your slideshow and gallery are archived.  There is a $50 fee to repost the images to the online gallery for an additional 14 days.     If you cannot decide which images to select during your ordering appointment, you are welcome to schedule another in-person viewing/sales appointment for a $100 fee.  If you still require an online gallery, one can be provided with a non-refundable deposit of $500.  This gallery will only be available for five days.  If you have not placed your order within five days, your $500 deposit will be forfeited.  All images not purchased will be purged after 30 days.    A missed viewing & sales appointment will require a $500 deposit in order to rescheduled the missed appointment.  The deposit will be applied towards the clients’ order when keeping the appointment; otherwise the client will forfeit their deposit should they fail to keep the second appointment or if they should fail to place an order at the second appointment.   All images include basic enhancements of color and lighting.  Individual display images of 16x20 or larger (not including unframed prints) automatically qualify for further enhancement techniques such as retouching and special effects.     Once an individual image (not a series) has been purchased as a wall display of 11x14 or larger, all gift print copies of that same image will be eligible for a 25% reduction in price.
Design proofing may be completed by email for layout and font selection ONLY.  Color approval is NOT possible by email due to the variations in customers monitors.  Brandon’s screens are continually professionally calibrated for correct image color.  To approve design work for color choice, clients must do so IN STUDIO on our professional color calibrated monitors.     The fee for additional retouching, modifications, and special effects of a single image smaller than 16x20 is charged according to the studio hourly rate of $75 with a $5 minimum fee.  This includes images for books, albums, collages, and other specialty items.  Brandon occasionally selects an image as an artist favorite and enhances that image as determined appropriate to his artistic vision.  There is no charge to the client for the artistic work on these images, though requests by the client to modify the work done will incur an additional fee.   Payment for your order must be placed in full and is subject to a 50% cancellation fee should you change your mind about an order after it is placed.  Once an order is sent to the lab, it is deemed non-refundable.  Payments may be made by cash, check, Visa, Master Card, or American Express.  Prices are non-negotiable and there are no product substitutions.  Payment plans are optional and without interest, but require two credit cards and an agreement to an automatic payment schedule.  Prices are subject to change at any time.  Current prices are valid for any order placed within 45 days of the session date.  Orders over $1000 are eligible for our payment plan. All products created include a 100% money back guarantee that is good for 30 days.  After 30 days items may be replaced if a defect such as warping, separation, or discoloration occurs.  Purchases will not be refunded either in part or in full, nor will the item purchased be replaced at the cost of the studio in the case of mishandling or abuse by the client.  All products are thoroughly inspected for defects or damage prior to notifying the client for pickup/delivery.  Products will then be inspected a second time with the client to ensure there is no visible defect or damage present at the time of customer pickup/delivery.  All orders will be signed for at pickup/delivery. Please allow 3-4 weeks for your order to be completed.  Some pictures may take longer.  Your portraits are an investment and an heirloom that should not be rushed.  You will be notified by telephone or email when your order is ready for pickup.  If you are unable to pick up your order, we can ship your order to you for an additional charge.  All ordered images are kept on file for a period of 1-year.  After 1-year, the images are moved to long term archiving for up to ten years.  Re-orders placed more than 60 days after the sales appointment require a minimum $150 re-order.    

Images provided for electronic sharing will be marked by the studio and are provided for the free and unlimited sharing by the client to mobile devices, computers, and social media sites only. These images are not allowed to be printed, cropped, or altered in any way. Doing so is a violation of the US Copyright Laws and may be subject to penalties and/or damages. The Copyright Act protects photographers by giving us the exclusive right to reproduce works created. Violations include, but are not limited to, making illegal copies, scanning, printing, or downloading from our website, blog, or any other online presence. It is illegal to copy, reproduce, or modify these photographs in any manner without our permission and violations of the Federal Copyright Law will be subject to its civil and criminal penalties. Please understand that we wish to maintain complete control over the print quality, finishes and presentation of our images. Any reproduction outside of the studio may lower the quality of the image and scar our reputation for providing superior portraits.

Brandon reserves the right to choose when to allow or not allow a deviation from the agreed policies.  If or when doing so, it will only be done for the purpose of providing special help to the client.  Such deviations from any one or more policies will be determined on a case-by-case basis and at no point will a deviation ever constitute a permanent change or omission of any policy and is not transferable from one client to another.
